Effective July 30, 2026. These are the terms for the penguinalert.com website and the Penguin Alert beta program. Plain language, short sections.

THE SHORT VERSION

The site is provided as-is. The waitlist is a line, not a ticket. The beta is pre-release software and may wobble. The game belongs to its maker. Be human with the forms. Colorado law applies.

WHO RUNS THIS

penguinalert.com is operated by Alexander Del Valle, the developer of Penguin Alert. When these terms say "we", they mean him. By using the site, you agree to these terms. If you do not agree, do not use the site.

THE SITE, AS-IS

The site is provided as-is and as available. We work to keep it accurate and online, but we do not promise it will be uninterrupted or flawless. Penguin Alert is coming soon to iPhone and iPad: there is no announced release date, and details may change before launch.

THE WAITLIST IS A LINE, NOT A TICKET

Signing the roster means we may email you about Penguin Alert. It does not guarantee a beta invite, access, or anything else. Beta slots are limited. When the beta opens, invites start with the waitlist, but a spot on the list is still not a promise of access. You can leave any list at any time through the support page.

BETA SOFTWARE: EXPECT THIN ICE

The TestFlight beta is pre-release software, provided as-is. It may crash, misbehave, lose saves, change without notice, or end at any time. Betas exist to find problems, and you may find some.

The beta is distributed through Apple's TestFlight, which has its own terms from Apple.

Feedback you send about the beta or the game (bug reports, ideas, complaints) may be used to improve the game, with no obligation or payment owed to you. It is welcome all the same.

THE APP STORE LICENSE

When Penguin Alert launches on the App Store, your license to the app is Apple's standard Licensed Application End User License Agreement. These website terms do not replace that license.

OWNERSHIP

The game, its name, its characters, its art, its sounds, and its code are the intellectual property of Alexander Del Valle, along with the content of this website. All rights reserved. Do not copy them, sell them, or pass them off as your own.

DON'T JAM THE RADIO

The waitlist and support forms are for humans. No spam, no bots, no automated submissions, no flooding. Entries that break this rule get removed.

LIABILITY

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or lost saves, arising from your use of the site or the beta. Where a limit is not allowed by law, it applies only as far as the law permits.

GOVERNING LAW

These terms are governed by the laws of the State of Colorado, USA, without regard to conflict-of-law rules.

CHANGES

If these terms change, the new version is posted on this page with a new effective date. Using the site after a change means you accept the update.
